关于对无人机相关物项实施出口管制的公告Announcement on the Implementation of Export Controls on Drone-Related Items

根据《中华人民共和国出口管制法》《中华人民共和国对外贸易法》《中华人民共和国海关法》有关规定，为维护国家安全和利益，经国务院、中央军委批准，决定对特定无人驾驶航空飞行器或无人驾驶飞艇相关物项实施出口管制。有关事项公告如下：In accordance with the relevant provisions of the Export Control Law of the People’s Republic of China, the Foreign Trade Law of the People’s Republic of China, and the Customs Law of the People’s Republic of China, in order to safeguard national security and interests, with the approval of the State Council and the Central Military Commission, it was decided to implement export control on specific unmanned aerial vehicles or unmanned airships related items. The relevant matters are announced as follows:
一、满足以下特性的物项，未经许可，不得出口：1. Items that meet the following characteristics may not be exported without permission:
（一）最大持续功率超过16千瓦（kW）的专门用于特定无人驾驶航空飞行器或无人驾驶飞艇的航空发动机（参考海关商品编号：8501200010、8501320010、8501330010、8501340010、8501400010、8501520010、8501530010、8407101010、8407102010、8408909230、8408909320、8411111010、8411119010、8411121010、8411129020、8411210010、8411221010、8411222010、8411223010、8411810002）。(1) Aero-engines with a maximum sustained power of more than 16 kilowatts (kW) dedicated to a specific unmanned aerial vehicle or unmanned airship (Reference customs commodity number: 8501200010, 8501320010, 8501330010, 8501340010, 8501400010, 8501520010, 8501530010, 840710101010, 8407102010, 8408909230, 8408909320, 8411111010, 8411119010, 8411129020, 8411210010, 84112210, 8411222010, 8411810002).
（二）满足一定技术指标的专门用于特定无人驾驶航空飞行器或无人驾驶飞艇的载荷，包括红外成像设备、合成孔径雷达和用于目标指示的激光器。(2) Loads dedicated to a specific unmanned aerial vehicle or unmanned airship that meet certain technical specifications, including infrared imaging equipment, synthetic aperture radar, and lasers for target indication.
1.具有下述任一特性的红外成像设备（参考海关商品编号：8525891110、8525892110、8525893110）：
（1）波长范围在780纳米（nm）至30000纳米（nm）之间；
（2）瞬时视场角（IFOV）小于2.5毫弧度（mrad）。		Infrared imaging equipment with any of the following characteristics (refer to customs commodity numbers: 8525891110, 8525892110, 8525893110):
(1) Wavelengths ranging from 780 nanometers (nm) to 30,000 nanometers (nm);
(2) Instantaneous field of view (IFOV) is less than 2.5 milliradians (mrad).
2.作用距离大于5千米（km），且具有下述任一特性的合成孔径雷达（SAR）（参考海关商品编号：8526109011）：
（1）条带模式分辨率优于0.3米（m）；
（2）聚束模式分辨率优于0.1米（m）。		2. Synthetic Aperture Radar (SAR) with a range greater than 5 kilometers (km) and having any of the following characteristics (cf. Customs Article No.: 8526109011):
(1) The resolution of the strip mode is better than 0.3 meters (m);
(2) The beam mode resolution is better than 0.1 m (m).
3.可在高于55摄氏度（℃）环境中稳定工作，且具有下述任一特性的用于目标指示的激光器（参考海关商品编号：9013200093）：
（1）免温控型；
（2）能量大于80毫焦（mJ）；
（3）稳定度优于15%；
（4）光束发散角小于0.3毫弧度（mrad）。		3. Lasers for target indication that can operate stably in environments above 55 degrees Celsius (℃) and have any of the following characteristics (Reference Customs Article No.: 9013200093):
(1) Temperature-free control type;
(2) energy greater than 80 mJ;
(3) Stability greater than 15%;
(4) The beam divergence angle is less than 0.3 milliradian (mrad).
（三）专门用于特定无人驾驶航空飞行器或无人驾驶飞艇，且具有下述任一特性的无线电通信设备（参考海关商品编号：8517629910、8517691002、8526920010）：
1.无线电视距传输距离大于50千米（km）；
2.一站控多机能力大于10架。		(3) Radio communication equipment specially used for a specific unmanned aerial vehicle or unmanned airship and having any of the following characteristics (refer to Customs commodity numbers: 8517629910, 8517691002, 8526920010):
Wireless TV transmission distance greater than 50 kilometers (km);
One-stop multi-machine control capacity is greater than 10 aircraft.
（四）民用反无人机系统：
1.干扰范围大于5千米（km）的反无人机电子干扰设备（参考海关商品编号：8543709960）；
2.专门用于反无人机系统的输出功率大于1.5千瓦（kW）的高功率激光器（参考海关商品编号：9013200093）。
技术说明：“特定无人驾驶航空飞行器或无人驾驶飞艇”是指满足商务部、海关总署公告2015年第31号（《关于加强部分两用物项出口管制的公告》）中1.1款所列条件的无人驾驶航空飞行器或无人驾驶飞艇。		(4) Civil anti-UAV systems:
1. Anti-drone electronic jamming equipment with a jamming range greater than 5 km (refer to Customs commodity number: 8543709960);
2. High-power lasers specially designed for anti-UAV systems with an output power greater than 1.5 kilowatts (kW) (see Customs Article No.: 9013200093).
Technical Note: “Specific unmanned aerial vehicle or unmanned airship” refers to an unmanned aerial vehicle or unmanned airship that meets the conditions listed in Subparagraph 1.1 of Announcement No. 31 of 2015 of the Ministry of Commerce and the General Administration of Customs (“Announcement on Strengthening the Export Control of Some Dual-Use Items”).
二、出口经营者应按照相关规定办理出口许可手续，通过省级商务主管部门向商务部提出申请，填写两用物项和技术出口申请表并提交下列文件：
（一）出口合同、协议的原件或者与原件一致的复印件、扫描件；
（二）拟出口物项的技术说明或者检测报告；
（三）最终用户和最终用途证明；
（四）进口商和最终用户情况介绍；
（五）申请人的法定代表人、主要经营管理人以及经办人的身份证明。		2. The exporter shall go through the export licensing procedures in accordance with the relevant provisions, apply to the Ministry of Commerce through the provincial commerce department, fill in the application form for the export of dual-use items and technologies, and submit the following documents:
(1) The original of the export contract or agreement, or a copy or scanned copy consistent with the original;
(2) Technical description or test report of the item to be exported;
(3) End-user and end-use certificates;
(4) Information on importers and end-users;
(5) Proof of the identity of the legal representative, main manager and manager of the applicant.
三、商务部应当自收到出口申请文件之日起进行审查，或者会同有关部门进行审查，并在法定时限内作出准予或者不予许可的决定。
对国家安全有重大影响的本公告所列物项的出口，商务部会同有关部门报国务院批准。		3. The Ministry of Commerce shall conduct a review from the date of receipt of the export application documents, or in conjunction with the relevant departments, and make a decision on approval or disapproval within the statutory time limit.
Exports of items listed in this announcement that have a significant impact on national security shall be submitted to the State Council for approval by the Ministry of Commerce in conjunction with relevant departments.
四、经审查准予许可的，由商务部颁发两用物项和技术出口许可证件（以下简称出口许可证件）。4. After review and approval, the Ministry of Commerce shall issue export licenses for dual-use items and technologies (hereinafter referred to as export licenses).
五、出口许可证件申领和签发程序、特殊情况处理、文件资料保存年限等，依照商务部、海关总署令2005年第29号（《两用物项和技术进出口许可证管理办法》）的相关规定执行。5. The procedures for the application and issuance of export licenses, the handling of special circumstances, and the retention period of documents and materials shall be implemented in accordance with the relevant provisions of the Ministry of Commerce and the General Administration of Customs Decree No. 29 of 2005 (“Measures for the Administration of Import and Export Licenses for Dual-Use Items and Technologies”).
六、出口经营者应当向海关出具出口许可证件，依照《中华人民共和国海关法》的规定办理海关手续，并接受海关监管。海关凭商务部签发的出口许可证件办理验放手续。6. Exporters shall issue export licenses to the Customs, go through customs formalities in accordance with the Customs Law of the People’s Republic of China, and accept customs supervision.The Customs shall go through the inspection and release procedures with the export license issued by the Ministry of Commerce.
七、出口经营者未经许可出口、超出许可范围出口或有其他违法情形的，由商务部或者海关等部门依照有关法律法规的规定给予行政处罚。构成犯罪的，依法追究刑事责任。7. If the exporter exports without permission, exports beyond the scope of the license, or other illegal circumstances, the Ministry of Commerce or the customs and other departments shall impose administrative penalties in accordance with the provisions of relevant laws and regulations.If a crime is constituted, criminal responsibility shall be investigated according to law.
八、本公告自2023年9月1日起正式实施。8. This announcement is formally implemented as of September 1, 2023.
